This is an appeal from a judgment of the Criminal Court of Marion County, Division 1, convicting the appellant of the crime of Robbery. The appellant was tried with his accomplice and without the intervention of a jury.

The record reveals that on the evening of October 13, 1966, the victim was a night attendant at a service station in Indianapolis and was working alone.
