Appeal from Travis. Tried below before the Hon. J. P. Richardson. On the fifth day of August, 1870, a special act was passed by the Legislature of the State of Texas entitled “An act to incorporate the International Railroad Company, and to provide for the aid of the State of Texas in constructing the same.” The Governor of the State neither approved the bill nor returned it to the house in which it originated, and the same became a law by reason of executive non-action within the constitutional period. This case came before this court on appeal by A. Bledsoe, as Comptroller of the State of Texas, from a judgment or decree of the District Court of Travis county, on a petition for mandamus commanding him to countersign and register certain bonds, claimed by the International Railroad Company, and fully described or set forth in their petition.
