Defendant, William F. Dalton, was indicted, tried and convicted by a jury of operating a motor vehicle while under the influence of intoxicating liquors, an offense defined in The Vehicle Code of May 1, 1929, P. L. 905, art. VI, sec. 620(/), as last amended by the Act of June 27, 1939, P. L. 1135, sec. 11, 75 PS §231.
