BAXTER, J.

—Defendant Jose Amaldo Rodrigues was convicted by a jury of one count of murder (Pen. Code, § 187),1 two counts of attempted robbery (§§ 664, 211), and one count of burglary (§ 459). The jury found true the special circumstances that defendant committed the murder while engaged in the crime of robbery or attempted robbery (§§ 190.2, subd. (a)(17)(vii), 211), and while engaged in the crime of burglary (§§ 190.2, subd. (a)(17)(vii), 460).
