McWhobtee, Judge:

This was a suit in chancery brought by Wm. A. Loar against John Wilfong in the circuit court of Monongalia county for the purpose of enforcing specific performance of the following contract:

“To William A. Loar:

I hereby acknowledge that as part of the consideration of the deed made for 9 3-4 acres of coal on Flaggy Meadow Run, this day made by yourself and wife to me I am to ■convey to you by deed of General Warranty a tract of land lying between jmur land and with the lines of my land and the crop of the Pittsburg vein of coal, with the understanding that I am to receive…
