Tbis is an action for tbe conversion of certain grain wbicb tbe plaintiff claimed under a chattel mortgage. Tbe defendant denied tbe conversion and damage to tbe plaintiff. Tbe case was tried to tbe court without a jury. Plaintiff bad judgment. Defendant moved for a new trial. Tbe motion was denied. Tbis appeal is from tbe order entered accordingly and from tbe judgment.

In January, 1925, Martin Johnson executed a mortgage to tbe Union Farmers State Bank of New Salem covering bis share of tbe crop to be raised in 1925 on tbe tilled portion of 400 acres of land in Oliver county. Tbis land…
