Appeal by the defendant, Abraham M. Averett, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 28th day of June, 1918, upon the decision of the court after a trial at the New York Special Term.

Philbin, J.:

The defendant appeals from a judgment rendered against him in an action brought by his wife for separation. The complaint among other things alleges cruel and inhuman treatment such as to render it unsafe and improper for plaintiff to cohabit with defendant. It is alleged that he called her low names and used vile and violent language to her; that he humiliated her in the presence of her family and friends; that he refused to associate with her, made slanderous statements concerning her and stated she was a vile woman and unfit to take care of their child; that plaintiff was in…
