Frank William Weaver was indicted on April 21, 1971 for willfully and knowingly failing to submit to induction into the Armed Forces, in violation of 50 App.U.S.C. § 462. It is not disputed that defendant intentionally failed to submit to induction as scheduled on November 16, 1970. He seeks to defend this prosecution by proving his induction order invalid, asserting several alleged procedural errors by the local board in the processing of his case which it is claimed constitute a denial of basic procedural fairness and violation of due…
