Dixon, the defendant, was indicted, tried, and convicted in the district court of Robertson county for the theft of a gold breast-pin, set with a diamond, of the value of $80, and his punishment assessed at three years' confinement in the penitentiary

He assigns the following errors committed by the lower court on his trial, viz. :
