The defendant on December 5,1927, pleaded not guilty in the County Court of Kings County to an indictment charging him with the crime of robbery in the first degree, grand larceny .in the first degree and assault in the second degree. On December 20,1927, he was permitted to withdraw his plea of not guilty and to “ plead guilty to the crime of Robbery in the First Degree without a gun On April 11, 1928, he was sentenced upon that plea to imprisonment in the State Prison at Sing Sing for a term of not less than fifteen nor more than thirty years.
