This appeal is from a judgment of the district court of Dallas county, Tex., dismissing the suit of appellant. A general demurrer and several special exceptions to appellant’s petition were sustained by the court and upon his refusal to amend a judgment of dismissal was entered. This judgment was rendered on the 26th day of December, 1926, and an appeal was filed in the court of Civil Appeals for the Fifth Supreme judicial district at Dallas, on January 5, 1927, and the cause was transferred to this court by the Supreme Court on June 25, 1927.
