LAWSON, Justice.

Lawrence N. Phillips was convicted of murder in the first degree and sentenced to death by electrocution, tie has appealed to this court under the provisions of Act No. 249, approved June 24, 1943, General Acts 1943, page 217, Code 1940, Tit. 15, § 382(1) et seq., which act provides for .an automatic appeal from the trial court in all cases in which the death sentence is imposed.

The three counts of the indictment charged appellant, a member of the Negro race, with the first-degree murder of Henry Louie, a Chinese, who operated a laundry in the City of Gadsden, Alabama. The…
