—Judgment unanimously modified on the law and as modified affirmed without costs and judgment granted in accordance with the following Memorandum: Petitioner currently operates a collection and transfer station for regulated medical wastes (RMW) in the Village of East Syracuse (Village). In June 1995 petitioner sought approval from the New York State Department of Environmental Conservation (DEC) to modify its facility by installing a microwave chamber, which would enable the wastes to be disinfected for disposal in an ordinary sanitary landfill.
