The defendants, Willie Nelson and David Jordan, are charged with the crime of jostling in violation of Penal Law § 165.25. On February 7,1985, a superseding information was filed with the court which alleges that Police Officer Michael Morgillo saw the defendants commit the offense of jostling on November 14,1984, at the subway at 53rd Street and Lexington Avenue.
