Claimant, Thaddeus Sofka, having previously taken a written examination conducted by the municipal civil service commission of the city of Poughkeepsie for the position of patrolman with the city police department, was notified by the commis*236sion to take an agility test. In response to that notice claimant appeared at the Poughkeepsie High School gymnasium at about 8:15 p.m. on January 19, 1950.
