1 At the trial in the court below, counsel for appellant moved to quash the first count of the indictment, which motion was overruled, and counsel also raised the same objection after the conviction of the appellant in the motion in arrest of judgment, which was also overruled and exception saved. The objection to the indictment is that it does not contain the words, “sexual or carnal,” but simply uses the words “unlawful intercourse.” This prosecution is under the laws of the United States, and it will be observed that under the laws of the United States the…
