October 1, 1931, appellant, Pevely Dairy Company, hereinafter referred to as defendant, filed a complaint in the District Court of the United States for the Southern District of Illinois against John B. Pearce and a large number of other persons, including appellee herein, who is hereinafter referred to as plaintiff.
