Kern, J.), entered on or about November 2, 2009, which, in an action for personal injuries allegedly sustained when the elevator car in which plaintiff Kirkwood Stewart was riding suddenly dropped, granted defendants’ motion for summary judgment dismissing the complaint, unanimously reversed, on the law, without costs, the motion denied, and the complaint reinstated.
