for the Court:

¶ 1. Deric Bailey was convicted by a jury in the Circuit Court for the First Judicial District of Hinds County of deliberate-design murder under Mississippi Code Section 97-3-19(1) (Rev.2006). Bailey was sentenced to life in prison. On appeal, Bailey’s conviction and sentence were reversed by the Court of Appeals and the case was remanded for a new trial. Bailey v. State, 952 So.2d 225 (Miss.Ct.App.2006). Ultimately, this Court denied Bailey’s petition for writ of certiorari. Bailey v. State, 951 So.2d 563 (Table) (Miss.2007). At his second trial,…
