MEMORANDUM AND ORDER

THEIS, Chief Judge.

Petitioner herein, having been granted leave to proceed in forma pauperis, has filed with the Clerk of the Court this petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254. A rule to show cause issued, to which respondents filed an Answer and Return, followed by the filing of petitioner’s Traverse thereto. Thereafter, an evidentiary hearing was conducted with petitioner present and represented by attorney Stephen W.
