This was a suit in equity filed by Southern Lumber & Supply Company to enforce a materialman’s lien against certain property described in the bill. The materialman’s interest was asserted as being superior to the interest in a mortgage on the premises held by First National Bank of Tampa, as assignee. The Chancellor entered a decree for the materialman, and the bank appealed. The question to be decided is whether or not the materialman ever acquired a statutory lien on the property involved, and if so, whether or not such lien was superior to the lien of the bank as assignee of the mortgage…
