Meyer, J.:

Defendant Timothy Snyder was originally charged with three counts of indecent liberties with a minor in violation of K.S.A. 1984 Supp. 21-3503, each a class C felony. The complaint alleged that the defendant had engaged in sexual intercourse with a child under the age of 16.

On October 17, 1983, the State presented evidence at the preliminary examination. After reviewing the evidence, Judge Davis of the Dickinson County District Court bound the defendant over for arraignment on counts I and II, but dismissed count III.
