Plaintiff, the Boston City Council, by James M. Kelly, City Council President (the “City Council”), brought this action against Thomas M. Menino, in his capacity as the Mayor of the City of-Boston (“Mayor Menino”), alleging that Mayor Menino has unlawfully interfered with the operation of the legislative branch, and has thereby prevented the City Council from performing its lawful functions, all to the detriment of the people of the City of Boston.
