*1226Appeal from an order of the Supreme Court, Onondaga County (Anthony J. Paris, J.), entered November 17, 2005. The order denied plaintiff’s motion for summary judgment and granted the cross motion of defendant-intervenor for summary judgment.
It is hereby ordered that the order so appealed from be and the same hereby is unanimously reversed on the law with costs, the cross motion is denied, the amended complaint is reinstated, the motion is granted, plaintiff is granted judgment against defendants and the matter is remitted to Supreme Court, Onondaga County, for a hearing in accordance with the…
