This was an action of ejectment brought by Joseph W. Redden, in ¿he district court of Shawnee county, against Joseph P. Heil, to recover the northeast quarter of section 11, township 13 of range 16 east. The court gave judgment in favor of the plaintiff for the east half of the quarter-section, and awarded the west half to the defendant; and the case was brought to this court and decided, and the opinion is found in 38 Kas., at page 255.
