Background

The plaintiff and the decedent, Malka N. Dembitzer, were divorced by judgment dated February 24, 2004 and entered March 8, 2004. The divorce judgment ordered, inter alia, for the sale of the marital home, and for the payment of marital debts from the proceeds of the sale with the remainder of the proceeds to be divided evenly between the parties.
