HEHDEBSOH, Judge.

Appellant was convicted of murder in the second degree, and his punishment assessed at confinement in the penitentiary for a term of twenty-five years, and prosecutes this appeal.

There is no merit in appellant’s application for continuance. The Bussells were evidently not at the dance on the night in question, as none of the witnesses saw them. Mrs. Clements was too remote from the scene of the homicide, and her testimony had no particular bearing on the question at issue.
