The action is to foreclose a first mortgage for $25,000 on certain real property situated in New York county. The mortgage in suit with the bond accompanying it was given by the defendant Slawson to the plaintiff on or about February 14,1906, and was payable on February 14, 1909, with interest at the rate of five and one-half per cent per annum, payable semi-annually. The mortgaged premises were subsequently and on or about March 29, 1917, conveyed by the defendant Slawson and his wife to the defendant the Calleott Construction Company.
