Appellant began this action by complaint against appellees in which it is alleged that he is a resident owner of real estate and personal property and a taxpayer of the city of North Vernon, and a patron of the municipally-owned waterworks in that city, and that he brings the action on behalf of himself and others similarly situated; that on March 9, 1933, the city was, and still is, a city of the fifth class, and the owner and operator of unincumbered waterworks used in furnishing the city and its inhabitants with water for public and domestic use; that on April 27, 1934, the common council…
