Petitioner Maurice Clarke ("Petitioner" or "Clarke"), proceeding pro se, seeks a writ of habeas corpus pursuant to 28 U.S.C. § 2255, (Petition, Feb. 24, 2010, dkt. no. 1) and petitions this Court to reject the Magistrate Judge's Report and Recommendation (the "Report" or "R & R") pursuant to 28 U.S.C. § 636 (b) (1).
