Appeal from a judgment of the County Court of Broome County (Smith, J.), rendered May 15, 2015, convicting defendant upon his plea of guilty of the crime of attempted criminal possession of a controlled substance in the third degree.

Defendant waived indictment and agreed to be prosecuted by a superior court information charging him with criminal possession of a controlled substance in the third degree. In satisfaction thereof, he pleaded guilty to attempted criminal possession of a controlled substance in the third degree without any agreement being made as to sentence.…
