Appeal from a judgment of the Supreme Court, Monroe County (Robert J. Lunn, J.), entered August 5, 2005. The judg*1156ment was entered upon an order granting the motion of defendants State of New York, New York State Division of State Police, and James W McMahon, individually and as Superintendent of New York State Police, seeking costs and sanctions against plaintiffs’ former attorney.

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously reversed on the law without costs and the motion is denied.
