A jury found appellant Gregory M. Small guilty m. rape, attempted rape, and sexual assault in the second degree, and imposed consecutive sentences on the charges of 240 months’, 144 months’, and 108 months’ imprisonment, for an aggregate sentence of 492 months’ imprisonment in the Arkansas Department of Correction. The Arkansas Court of Appeals affirmed the judgment. Small v. State, CACR 04-1390 (Ark. App. June 22, 2005). Appellant timely filed in the trial court a pro se petition for postconviction relief under Ark. R. Crim. P. 37.1, 1 which was denied without a hearing. This court granted…
