I. BACKGROUND

This case is before this court on appeal from an order entered on May 24, 1993, in this declaratory judgment diversity action. We will affirm.

The appellee Sandra Carrick filed this action, individually, and as executrix of the Estate of Michael J. Carrick, in the Court of Common Pleas of Crawford County, Pennsylvania, against the defendant-appellant Zurich-Ameriean Insurance Group, an Illinois corporation.
