This proceeding arises out of a worker’s compensation claim filed with the Industrial Accident Board (“Board”) by plaintiff-appellant, Ernest Joseph (“Joseph”) against defendant-appellee C.C. Oliphant (“Oliphant”), seeking commutation of compensation for work related injuries and an award of attorney’s fees to be paid by Joseph. Between December, 1977 and October, 1994, counsel recovered in excess of $135,000.00 in disability benefits for Joseph.
