This action was commenced by plaintiff in error against defend ant in error for a divorce, custody of the children, alimony, and division of property. The parties will hereinafter be referred to as plaintiff and defendant as they appeared in the} lower court.

Defendant filed his answer and cross-petition, in which the allegations upon which plaintiff relied for divorce were denied, and divorce was asked by. the defendant on the grounds of adultery, gross neglect of duty, and extreme cruelty.
