1. This suit was filed at the March term, 1891, of Dooly superior court. At the September term, 1892, the plaintiff amended the declaration. The defendant demurred to the amendment and the demurrer was overruled, and he then filed exceptions pendente lite to the overruling of *571the demurrer. The case was tried at the September term, 1893, and a verdict was rendered in favor of the plaintiff. TJpon a motion for a new trial -by the defendant, the court set the verdict aside, and the plaintiff excepted and brought the case to this court. This court affirmed the judgment and…
