Dear Mr. Wingfield:

This is in response to your request for an opinion on the legality of paying constitutional officers to serve as special judges. Specifically, you note that the Auditor acts as disbursing officer of the appropriation for the payment of special judges. You also note that newly adopted Act 34 of 1999 presents a potential issue in this regard.
