This is an action to recover for personal injuries claimed to have resulted from the administration by a hospital nurse of an intravenous injection of a dye used for X-ray purposes. Plaintiff was admitted to Morrisania City Hospital on September 19, 1951, acutely ill from a kidney ailment diagnosed as ureteral calculus and pyelonephritis. He was then 29 years old and had immigrated from Poland two years pre*228viously.
