The plaintiff, Harry J. North, filed suit in the Circuit Court of Jackson County against the defendant, Esther C. Hawkin-son, Executrix of the Estate of Axel Haw-kinson, Deceased, to recover judgment against the estate for his share of the profits of a partnership claimed to have been entered into between the plaintiff and Mr. Hawkinson in his lifetime. On motion of the defendant, plaintiff’s petition was dismissed on the grounds that (1) it failed to state a claim upon which relief could be granted, (2) the claim was barred by nonclaim statutes of the new probate code,…
