Following a jury trial, defendant Andre Richardson was convicted of the first degree murder of his 11-month-old daughter and was sentenced to 40 years’ imprisonment. In People v. Richardson, 376 Ill. App. 3d 537 (2007), we reversed defendant’s conviction on the basis that the trial court erred in denying his motion to suppress where the State failed to prove by clear and convincing evidence that defendant’s eye injury was not inflicted in order to obtain a confession.
