Petitioner brings this article 78 proceeding to review the determination of the Police Commissioner of the City of New York in dismissing petitioner from the Police Department of the City of New York.

Petitioner was charged "with conducting himself in a manner tending to bring adverse criticism on the Police Department in that he did live with a certain unmarried woman as man and wife, while in fact married to someone else, in addition to other conduct arising out of his relationship with this woman and various other violations of Police Department rules.
