An indictment containing two counts, and concluding, “contrary to the form of the statute in such case made and provided,” was returned into the circuit court of Kane county, charging, in the first count, that the plaintiff in error, Emory Hartsig, and others therein named, “did conspire and agree together with a fraudulent and malicious intent then and there feloniously, wrongfully and willfully to obtain the sum of $15 * * * of the moneys, goods, chattels and personal property of W.
