MEMORANDUM OPINION AND ORDER

INTRODUCTION

The Chapter 7 trustee in this case which was converted from Chapter 13 objected to debtor’s claim of exemption in automobile accident proceeds paid to the debtor prior to conversion. The debtor claimed the accident proceeds exempt in his Chapter 13 schedules and the Chapter 13 trustee did not object to the exemption. The issue before this court is whether the Bankruptcy Code affords the Chapter 7 trustee a new opportunity in the 30 days following the section 341 meeting of creditors in the converted case, to object to…
