Plaintiff brought suit against defendants in the State Court of Hall County. The complaint was couched in two counts. In Count 1, plaintiff sought $157,045.42 against defendants pursuant to a policy of insurance. It also sought a penalty of 25 percent of the amount due, reasonable attorney fees and the cancellation of certain security instruments.
