Affirming.

On February 16, 1926, Charlie Litteral shot and killed Sherman (Owens. He was indicted for murder and on his trial under that indictment, which was begun on February 22, 1927, he was convicted of manslaughter, •and his punishment fixed at confinement in the penitentiary for seven years. He sought a new trial upon seven grounds, which we shall discuss after briefly stating the facts. The deceased was by vocation a railway switch-man and by avocation a bootlegger.
