¶44. I respectfully dissent from the majority’s opinion and would reverse the circuit court’s grant of summary judgment in favor of Yates Engineering, ARMC, and Foil Wyatt. Although the majority did not reach the issue, I would also reverse the circuit court’s grant of summary judgment *1049against Medina.
