The principal controversy in this action is in relation to whether there existed an enforceable contract between the parties, by virtue of which the defendant was under any obligation to deliver beer to the plaintiff. There was no written contract between the parties. The plaintiff relied upon an alleged oral agreement, but the making thereof was disputed by the defendant.
