Appeal, by permission, from that part of an order of the County Court of Albany County (Herrick, J.), entered April 28, 2008, which denied defendant’s motion pursuant to CPL 440.10 to vacate the judgment convicting him of the crimes of criminal sale of a controlled substance in the third degree (two counts), attempted criminal sede of a controlled substance in the third degree, criminal possession of a controlled substance in the third degree and criminal possession of a controlled substance in the fifth degree, without a hearing.
