MORROW, District Judge.
On the 10th day of November, 1889, the schooner Fidelity, while being towed from the Pacific ocean into Humboldt bay by the steam tug Printer, was capsized on Humboldt bar. The captain and all hands on board the schooner were drowned, and the vessel itself drifted away, and became a total loss. On March 17, 1890, the Humboldt Lumber Manufacturers’ Association, charterer of the steam tug Printer, filed a petition in this court, setting forth the loss of the schooner Fidelity, and alleging *430that three separate actions had been commenced against the petitioner in the…
